Welcome to the Brahma.fi Console, a sophisticated, non-custodial platform designed for experienced DeFi users . Console offers enhanced tools for on-chain connectivity to decentralised applications (dApps) and streamline execution.
Console is built on top of open source smart contracts and the Ethereum blockchain. Please be aware that the functionality of Brahma.fi Console is subject to the dynamics of blockchain technology, as well as internal systems provided by Brahma.fi, such as the Console UI. Brahma.fi reserves the right to modify, suspend, or discontinue our services at any time without notice. We encourage users to thoroughly review our documentation to understand the Console’s capabilities and the risks involved, including digital asset volatility and market fluctuations.
1. Acceptance of Terms
By accessing, registering for, or utilising the Brahma.fi Console, you affirmatively acknowledge and signify your understanding and acceptance of these Terms and Conditions. This acknowledgement is a binding agreement indicating your compliance with and commitment to these terms. If at any point you find yourself in disagreement with any of the stipulated terms, it is advised that you discontinue the use of the Brahma.fi Console immediately. Your continued use of the console signifies ongoing acceptance of these terms and any future modifications that may be implemented.
2. Modifications to These Terms
Brahma.fi reserves the right to modify these Terms at our sole discretion from time to time. Should there be any changes, we will notify you through appropriate channels, such as via service notifications, and/or by updating the date at the top of these Terms. These modifications become effective immediately upon notification. By continuing to use Brahma.fi Console after such notifications, you acknowledge and accept the revised Terms. If the amended Terms are not acceptable to you, your sole recourse is to cease using our Services.
3. Services
3.1 Overview of Services
Brahma.fi Console primarily enables users to interact with smart contracts and manage exposure to risk through open-source software and DeFi instruments ("the Services").
3.2 Third-Party Links and Protocols
Users must possess a thorough understanding of blockchain technology, smart contracts, and specific protocols when interacting with our Services. We do not guarantee that the use of the Site or any content from the Site will not infringe the rights of third parties.
3.3 Ethereum Contract Interactions and Gas Charges
By using the Brahma.fi Console for interactions with Ethereum blockchain smart contracts, you acknowledge your responsibility to pay all associated Gas Charges. These charges are determined by the Ethereum network and can fluctuate based on network congestion and transaction complexity. Brahma.fi has no control over these charges and cannot predict their exact amount. It is your responsibility to ensure that your connected Ethereum wallet has sufficient Ether (ETH) to cover these charges for your transactions to be successfully processed. You acknowledge this requirement and accept that managing your Ether balance to accommodate Gas Charges is an essential aspect of using the Brahma.fi Console.
3.4 Conditions and Restrictions
We reserve the right to restrict or impose conditions on your access and use of the Services or Portal at our sole discretion, with or without notice.
3.5 No Broker, Legal, or Fiduciary Relationship
Brahma does not hold a broker, legal, intermediary, agent, or advisor role nor a fiduciary relationship with you. Our communications and information are not intended as advice. The content on the Site is informational and should not be relied upon for making an offer, solicitation, invitation or recommendation to buy or sell investments, securities or any other financial services and is not intended to be relied upon by you in making any specific investment or other decisions. We advise seeking independent financial advice for such decisions. The Site does not constitute an offer or solicitation for investment or financial services in any jurisdiction.
3.6 Unacceptable Use or Conduct
As a condition to accessing or using the Portal or the Services, you will not: (a) violate any Applicable Law, including, without limitation, any relevant and applicable anti-money laundering and anti-terrorist financing laws, such as the Bank Secrecy Act, each as may be amended; (b) infringe on or misappropriate any contract, intellectual property or other third-party right, or commit a tort while using the Portal or the Services; (c) use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services in any manner; (d) attempt to circumvent any content filtering techniques or security measures that Brahma employs on the Portal, or attempt to access any service or area of the Portal or the Services that you are not authorized to access; (e) use the Services to pay for, support, or otherwise engage in any illegal gambling activities, fraud, money-laundering, or terrorist activities, or other illegal activities; (f) use any robot, spider, crawler, scraper, or other automated means or interface not provided by us, to access the Services or to extract data; (g) introduce any malware, virus, Trojan horse, worm, logic bomb, drop-dead device, backdoor, shutdown mechanism or other harmful material into the Portal or the Services; (h) provide false, inaccurate, or misleading information; (i) post content or communications on the Portal that are, in our sole discretion, libelous, defamato ry, profane, obscene, pornographic, sexually explicit, indecent, lewd, vulgar, suggestive, harassing, hateful, threatening, offensive, discriminatory, bigoted, abusive, inflammatory, fraudulent, deceptive or otherwise objectionable; (j) post content on the Portal containing unsolicited promotions, political campaigning, or commercial messages or any chain messages or user content designed to deceive or trick the user of the Service; (k) use the Portal or the Services from a jurisdiction that we have, in our sole discretion, or a relevant Governmental Authority has determined is a jurisdiction where the use of the Portal or the Services is prohibited; or (l) encourage or induce any third party to engage in any of the activities prohibited under this Section 3.7.
3.7 Your Responsibilities
By accessing or using our Services, you agree to use them lawfully and in accordance with these Terms. You must provide accurate, complete, and current information and maintain the security and confidentiality of your Ethereum Address.
3.8 Your Assumption of Risks
You must have the technical expertise to evaluate security and operation, and understand the risks associated with Ethereum Address, Ethereum Blockchain, Ether, and option Positions. You assume all risks associated with these elements and release Brahma from any claims related to these risks.
3.9 Non-Custodial Nature of Services
Full Responsibility for Funds
Brahma.fi operates as a non-custodial service. We do not have custody or control over your funds. You are solely responsible for managing and securing your funds within Brahma.fi Console.
Understanding Non-Custodial Risks
By using our service, you agree to be fully responsible for managing your funds, private keys, passwords, and any other authentication methods.
4. No Warranty
Brahma.fi offers its Console and services on an "AS IS" and "AS AVAILABLE" basis, devoid of any kind of warranties. We explicitly disclaim all warranties, whether they are express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We cannot ensure uninterrupted or secure access to our service, as its operation may be affected by external factors beyond our control.s.
5. User Responsibility for Legal Compliance
As a user of the Brahma.fi Console, you are solely responsible for ensuring that your use of our services complies with all applicable local, state, national, and international laws and regulations. This includes, but is not limited to, regulations pertaining to financial services, securities, privacy, and data protection.
6. Disclaimers
Brahma.fi does not warrant that the Site will be completely secure, or that it will be free from bugs or viruses. As a user, you bear the responsibility for configuring your information technology, computer programs, and platform to safely access the Site. We strongly recommend that you employ your own virus protection software to safeguard your systems when using our services.
7. General Provisions
Third-Party Execution of Obligations
Brahma.fi reserves the right to delegate any of our obligations or exercise any rights granted to us under these Terms through a third party. We may also assign our rights and obligations under these Terms to any third party.
No Waiver
Any single or partial exercise, failure, or delay in exercising any right, power, or remedy by Brahma.fi does not constitute a waiver of that or any other right, power, or remedy. These rights, powers, or remedies are applicable under these terms and conditions or otherwise.
Validity in Case of Illegality
If any provision in these Terms is deemed illegal, invalid, or unenforceable by a court of competent jurisdiction, the remainder of the Terms shall continue to be valid and enforceable.
Survival of Provisions
All disclaimers, indemnities, and exclusions in these Terms will survive the termination of these Terms. They will continue to apply during any suspension or any period when the Site is not available for use for any reason.
Entire Agreement
These Terms, along with any referenced documents, constitute the entire agreement between you and Brahma.fi regarding the use of the Site, BrahmaFi, and the services provided via the Site. They supersede all prior or contemporaneous representations, communications, or agreements, whether written or oral, between you and us.
8. Limitation of Liability
Brahma.fi, its affiliates, and their respective officers, directors, employees, agents, or suppliers will not be liable for any losses or damages whatsoever. This exclusion applies to direct, indirect, punitive, incidental, special, or consequential damages, including, but not limited to, damages for loss of use, data, profits, or other intangibles. These limitations apply whether the damages arise from the use or performance of the Brahma.fi console, delay or inability to use the console, or from any information, software, products, services, and related graphics obtained through the console. This non-liability applies regardless of the basis of the claim, whether it's contract, tort, negligence, strict liability, or any other legal theory.
9. Indemnification
By using the Brahma.fi Console, you agree to indemnify and hold harmless Brahma.fi, its subsidiaries, affiliates, officers, agents, partners, and employees from any losses, liabilities, claims, or demands, including reasonable attorneys' fees. This indemnification applies to claims made by any third party due to or arising from your use of the Brahma.fi Console in a manner that violates this Agreement, or from any breach of this Agreement, including but not limited to your representations and warranties.
10. Arbitration Agreement
Under the BrahmaFi General Terms of Use, any dispute, claim, question, or disagreement stemming from or related to these Terms and Conditions, or their breach, is to be settled exclusively through mandatory individual arbitration. This means disputes will be resolved on an individual basis, without resort to any form of class action or jury trial.
Arbitration replaces the right to go to court and involves a neutral arbitrator instead of a judge or jury. It is understood that by agreeing to arbitration, both parties waive the right to a trial by jury or to participate in a class action.
